Local municipality opts out of retail cannabis

ROUSES POINT | The Village of Rouses Point adopted Local Law No. 2 of 2021 on Dec. 20 at the regularly scheduled meeting of the Village Board. The Village of Rouses Point decided to opt-out of allowing retail cannabis dispensaries and on-site cannabis consumption establishments from locating and operating within the Village of Rouses Point. While New York State has legalized the use of cannabis, individual municipalities have the authority to prohibit retail cannabis dispensaries as well as establishments where cannabis is consumed on location. Under the New York State law, municipalities can choose to opt-out of legalizing cannabis local sales and choose to opt-in at a later date. However, municipalities can't choose to legalize cannabis local sales, and then decide to opt-out at a later date. Municipalities do not have the power to opt-out of adult-use legalization. "Adult-use cannabis possession and use by adults 21 years of age or older in accordance with the Marijuana Regulation & Taxation Act (MRTA), is legal in New York State," the Office of Cannabis Management states on its website. Municipalities had until Dec. 31, 2021, to pass a local law opting out of allowing adult-use cannabis retail dispensaries or on-site consumption licenses. For anyone wishing to protest against the adoption of the Village of Rouses Point Local Law No. 2, must file a petition with the village clerk within 30 days of the adoption of the local law.
