Schuyler Falls man pleads guilty in police shooting case

SCHUYLER FALLS | A Schuyler Falls man will now serve 12 years in prison following a volatile standoff with police left him hospitalized and facing attempted murder charges. Kevin Doherty's plea to attempted aggravated assault upon a police officer resolves the high-level case involving an early December standoff at his former Rabideau Street residence. According to the Clinton County District Attorney's Office, Doherty, 34, reappeared in Clinton County Court May 20 when he pleaded guilty in satisfaction of the charges against him. Authorities have said what started as a wellness check for a suicidal male quickly escalated when Doherty refused to leave his residence and fired a shotgun blast at responding officers, resulting in returned fire that left him hospitalized and facing a slew of charges. Doherty, who was represented by public defender Jamie Martineau, is now facing a determinate sentence of 12 years behind bars, five years post-release supervision and a fine of up to $5,000. He will also pay several surcharges and court-related fees. According to the DA's Office, Doherty was cooperative with the investigative proceedings and remorseful of his actions. In recommending the 12-year sentence, the District Attorney's Office took into consideration his physical and mental condition at the time of the incident, including reported suicidal ideations, his subsequent remorse and cooperation and a toxicology report that found the presence of alcohol and benzodiazepine drugs in his system at the time of the incident. The case was investigated by New York State Police, the Bureau of Criminal Investigation and the Forensic Investigation Unit. The case was prosecuted by Assistant District Attorney Vivian Joo with the assistance of District Attorney Andrew Wylie. Doherty will be sentenced by Judge William Favreau July 29.
